Terms and Conditions

Please read these terms and conditions carefully as they describe our and your rights and obligations. In these terms and conditions, "we", "us" and "our" refer to us, "you" and "your" means all persons named on the order, “goods” means the product being purchased. When you make an order with us you are accepting these terms of these conditions. These terms and conditions shall be governed by the laws of England and Wales, and any disputes shall be subject to the jurisdiction of the UK courts.

1. Vehicle Sales

1.1 Delivery

We offer a United Kingdom mainland nationwide delivery of all our vehicles free of charge. We can also arrange to deliver your vehicle outside of the United Kingdom to almost anywhere in the world. Additional shipping costs will apply. Our delivery team will be able to advise you of any additional costs.

All our vehicles meet and or exceed the United Kingdom standards for safety and emissions as governed by the Driver and Vehicle Standards Agency (DVSA) and the Vehicle Certification Agency (VCA). Where vehicles are to be delivered outside of the United Kingdom, we will work with you to allow your vehicle to meet and or exceed the standards for safety and emissions as governed by that countries local authority.

1.2 Warranty

We offer a 12 month warranty on all vehicle sales. If you have any issues with your vehicle, you should read the warranty pack provided at time of sale, then contact our warranty team by calling 0203 728 8450 or email warranty@minireborn.com. If your vehicle is located within the mainland United Kingdom, you can either choose to have our Flying Technician come to your location, or arrange with us to have your vehicle brought back to one of our service centres. If your vehicle is located outside mainland United Kingdom, contact us and we can help arrange one of our preferred partners to support your warranty claim.

To keep your warranty valid, you must follow the manufacturers recommended service and maintenance schedule. Failure to do so may result in your warranty becoming void.

1.3 Return of Goods - In-Person Purchases (On-Premises Sales)

If you purchase a vehicle in person at our premises, you do not have an automatic legal right to cancel the contract once it has been signed and the vehicle has been collected or delivered. However, your statutory rights remain protected under the Consumer Rights Act 2015, which entitles you to:

Reject the vehicle within 30 days of purchase if it is found to be faulty, not as described, or unfit for purpose, and receive a full refund.

Request a repair or replacement if a fault arises after 30 days but within 6 months, unless we can prove the fault was not present at the time of sale.

1.4 Return of Goods - Distance or Off-Premises Purchases (e.g. Online, Telephone)

If you enter into a contract with us at a distance (such as via our website or over the phone), you have a right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013:

You may cancel the contract within 14 calendar days of the day you receive the vehicle, without giving a reason.

To exercise this right, you must inform us in writing (email or letter) within the 14-day period.

If you cancel, you must return the vehicle to us at your own cost unless otherwise agreed.

A full refund, including standard delivery charges (if applicable), will be issued within 14 days of us receiving the vehicle back, or evidence that it has been returned.

Exemptions

The right to cancel may not apply to:

- Customised or made to order vehicles
- Trade or commercial sales
- Vehicles purchased in part-exchange where your previous vehicle has already been sold or disposed of

1.5 Cancellations by us

We reserve the right to cancel your order at anytime. Any cancellation by us will be deemed to be a minor change and no compensation will be payable.

1.6 Mini Bespoke

For Mini Bespoke vehicle, parts or accessories sales, we require a 10% deposit at time or sale to secure your order. Deposits are not refundable after 24 hours from date and time of sale.

Unless faulty or damaged on delivery, it will not possible to cancel or return any Mini Bespoke vehicle, parts or accessories sales as these will be made specifically to your individual requirements.

1.7 Care of Goods

To ensure you continue to enjoy your item, please follow the care instructions which you will find enclosed within your packaging. Following these simple care instructions will ensure your item maintains its appearance and feel.


2. Parts, Accessories and Merchandise Sales

2.1 Delivery

Deliveries to the United Kingdom should arrive within 5 working days, mainland Europe with seven working days and rest of the world within fourteen working days unless otherwise stated. All orders are dispatched within one working day of us accepting your order, unless otherwise stated. All deliveries will be made to the address you provide at the time of order. There will be a delivery charge from £9.99.

2.2 Return of Goods (Excluding Bespoke Order Items)

You can return your item within fourteen working days of you receiving it. Items returned must be complete, unopened, in its original sealed packaging and in a re-saleable condition. Any items returned which have been removed from its sealed packaging will not be refunded or exchanged unless it is faulty or damaged on you receiving it. This does not affect your statutory rights.

2.3 Cancellations by you

You can cancel your order with us at any time within fourteen days of you receiving it, inline with our Return of Goods policy.

2.4 Bespoke Order Items

Unless faulty or damaged on delivery, it will not possible to return or cancel any bespoke items including parts, accessories and merchandise as these will be made specifically to your individual requirements.

2.5 Fitting

If you choose to fit any part or accessory you order from us yourself or through any garage or installation service chosen by you, you must ensure that the part or accessory is fitted correctly. We are not responsible for any damage to the part, the accessory or your vehicle for any parts or accessories which are not fitted by ourselves.

2.6 Care of Goods

To ensure you continue to enjoy your item, please follow the care instructions which you will find enclosed within your packaging. Following these simple care instructions will ensure your item maintains its appearance and feel.

2.7 Pre Orders

For pre order items, we will contact you to arrange delivery once your pre ordered item has arrived in to stock.


3. Mini Tyre Programme

- Tyre claims will be eligible from month 3 of your 12 month subscription period
- If you need a repair or replacement tyre, simply take your vehicle to your chosen garage or repair centre
- You must contact our support team prior to having any tyre repaired or replaced so that we can approve the tyre repair or replacement required with the chosen garage or repair centre
- Any repair or replacement made without our prior approval may not be covered under the Mini tyre programme
- You must complete a full 12 month subscription period of payments regardless of when your claim is within the subscription period
- If we are unable to collect payment within 3 days following its due date, your subscription will be cancelled and all outstanding payments amounts will be due in full
- Only 4 tyres can be claimed for in any 12 month subscription period
- Subscription payments must be made via debit or credit card which must be in your name


4. Mini Service Programme

- Service claims will be eligible from month 3 of your 12 month subscription period
- You must complete a full 12 month subscription period of payments regardless of when your claim is within the subscription period
- Mini services under the Mini service programme can only be conducted through our own service centres including our Flying Technician
- Any Mini services conducted outside of our own service centres will not be covered under the Mini service programme
- If we are unable to collect payment within 3 days of its due date, your subscription will be cancelled and all outstanding payments amounts will be due in full
- Only 1 service claim is permitted in any 12 month subscription period
- Subscription payments must be made via debit or credit card which must be in your name


5. Flying Technician

- We will advise you of the cost of any parts required
- If you do not choose to have any additional non included part(s) fitted to your mini, the £149 flying technician cost will still be charged to you
- If we are unable to resolve your issue with your mini, the £149 flying technician cost will still be charged to you
- If you cancel your booking within 24 hours of your confirmed booking date, the £149 flying technician cost will still be charged to you
- If you require additional non included part(s) which are not in stock, we will arrange with you a separate fitting date for these additional non included part(s). You will not be charged for this additional fitting date
- Flying Technician is currently only available in the United Kingdom


6. Mini Fit

- We will advise you of the cost of any additional non included part(s) before we start work on your mini
- If you do not choose to have any additional non included part(s) fitted to your mini, the Mini Fit cost will still be charged to you
- If you cancel your booking within 24 hours of your confirmed booking date, the Mini Fit cost will still be charged to you
- If you require additional non included part(s) which are not in stock, we will arrange with you a separate fitting date for these additional non included part(s). You will not be charged for this additional fitting date
- Mini Fit is currently only available in the United Kingdom


7. All Sales

7.1 Payments

All payments will be taken by credit or debit card and will be made in UK pound sterling. We accept Visa, MasterCard, Maestro and JCB.

7.2 Colour Disclaimer

Please note, colours may appear slightly different in person due to variations in screen displays and device settings.

7.3 Liability

We accept no liability for any loss or damage to you, your vehicle, or your belongings arising from the incorrect or improper use of our products.
